Abstract:In common law, simply stated, a tort is a wrong. It is a private wrong(civil as opposed to criminal) resulting from a breach of a legal duty derived from society’s expectations regarding proper and improper interpersonal conduct.The British Tort law is one of the oldest legal departments in common law. It developed on the foundation of “the action of trespass”. Different torts are applied to different procedures and different rules.
In Britain, a tort is any socially unreasonable conduct, which is not comtractual, for which a conrt will grant monetary dameges or an equitable remedy to compensate an individual for his/her injury. The rights and duties involed in a tort case may arise from either statute or common law.This article introduces the historical background, major classfication, the principles of liability. And the author try to do further theoretical research in tort law.

有一点简单的是 法律程序不同，
英美法律中的“正当法律程序”，就他的最低标准而言，要求：公民的权利义务将因为决定而受到影响时，在决定之前必须给予他知情和申辩的机会和权利。对于决定者而言，就是履行告知和听证的义务。（就是人们在电影里常听到的：你有权保持沉默，但是。。。。）如果你在抓人前不这么说，那么很有可能最后他会被判无罪！
还有法的制定，英美法律承认大法官立的法！中国不能！
