Medical examinations play an important role and are governed by law. The COTOREP, which allocates the disability rate and offers guidance to handicapped people, is made up of more than twenty members including at least three doctors (art. D.323-3-1 of the labour code).
According to article L. 241-1 of the labour code, employers are required to organise the health services. The role of the company doctor, which is exclusively preventive, “consists of preventing all alterations in the health of workers due to their work, particularly by monitoring hygiene conditions at work, risks of contagion and the health of the workers” (art. L. 241-2). The company doctor may suggest individual adaptations justified by age, resistance and the physical or mental conditions of the employees.. He may also confirm the inability of a person to occupy his position (art. L. 122-24-4 et L. 122-45).
In administrations, in addition to the COTOREP’s decision, an appointed doctor must certify the capacity of a person to occupy the position in question.
