According to articles R. 232-1-8 and R. 232-2-6 of the labour code, the employer must adapt the work place for handicapped people, including the canteen and toilets. This must not, however, incur disproportionate costs (financial assistance may be obtained for these adaptations). The company doctor may also suggest adaptations (art. L. 241-10-1). Certain posts may be specially adapted on a part time basis or with special conditions relating to the handicap (art. L. 323-29 and R. 323-59) ; the employer may receive a grant in return.
The new law will be much more demanding. Chapter II of section III “Employment, adapted work and sheltered work”, whose section I is entitled “principle of nondiscrimination” begins with an article inspired by article 5 of directive 2000/78 EC. Its wording, which has not yet been finalised, has been drafted several times. Article 11 of the government’s preliminary draft quoted the textual terms of the directive :
